Privacy Policy
This Policy explains how your Personal Data is collected, used and disclosed by Sosúa Ocean Village (hereinafter “the Company”, “we”, “us”, “our” or “our”). This Policy encompasses our data collection activities online and by other methods, including Personal Data we collect through our various channels such as websites, apps, social networks, customer service call centers, customer service offices, sales and rentals, events, and so on. Please be advised that we combine Personal Data we collect from our consumers through one method (e.g., a social network) with Personal Data we collect through another method (e.g., a customer form filled out offline). In this regard, we may combine Personal Data that we initially collected through different methods.
I. Sources of Personal Data
This Policy applies to Personal Data that we collect from or about you through the following sources:
Sosúa Ocean Village website. Customer-facing website operated by Sosúa Ocean Village, including sites we operate under our own domains (URLs and mini-sites we manage on third party social networks such as Facebook (“Websites”).
Sosúa Ocean Village mobile websites/apps. Consumer-facing mobile websites or apps operated by or for Sosúa Ocean Village, such as smartphone apps.
E-mail, text messages or other electronic messages. Electronic communications between you and Sosúa Ocean Village.
Sosúa Ocean Village Customer Service Center. Calls to our customer service center
Sosúa Ocean Village Administrative Offices. Customer service, sales and rental offices managed by Sosúa Ocean Village.
Paper registration forms. Paper registration forms or similar forms that we collect through, for example, point-of-sale, contest demonstrations and other promotions or events.
Data from other sources. Social networks and Internet operators (Facebook, Instagram, Google, etc.) or information obtained through market research.
II. Personal data we collect about you and how we collect it.
Depending on how you interact with Sosúa Ocean Village (online, in person, by telephone, etc.) we collect various types of information from you, as described below.
Personal contact information. This includes any information you provide that allows us to contact you, such as your name, mailing address, email address, social media details or phone number.
Account Registration Information. Any information that is required to allow you access to your specific account profile. Examples include your alias for login identification, your email address, your username, your password in an unrecoverable form and/or security question(s) and answer(s).
Demographic Information. Any information that describes your demographic or behavioral characteristics. Examples include your date of birth, age or age range, gender, geographic location, favorite products, hobbies and interests, and home and lifestyle information.
Technical information about computer/mobile devices. Any information about the computer system or other technological device you use to access our Websites or apps, such as the Internet Protocol (IP) address used to connect your computer or device to the Internet, the type of operating system, and the type and version of web browser. If you access the Sosua Ocean Village website or app through a mobile device such as a smartphone, the information collected will also include, where permitted, your phone's unique device identifier, advertising ID, geographic location and other similar mobile device data.
Websites/usual communication information. As you browse and interact with our Websites or newsletters, we use automated data collection technologies to collect certain information about your actions. This includes information such as the links you click on, the pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors, and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons and is also collected through the use of third party tracking services. You have the right to object to the use of such technologies.
Market research and customer feedback. This includes information that you voluntarily share with Us about your experience using our services.
Customer Generated Content. Refers to any content that you create and then share with Us on a social network or by uploading to one of Our Websites or apps, including using social networking apps such as Facebook and Instagram. Examples include photos, video, personal stories or other similar media or content. Where permitted, We collect and post consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, customer-driven events and third-party social networking.
Social Networking Information. Refers to any information that you share publicly on a social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with Us. Examples include your basic third party account information (e.g. name, email address, gender, date of birth, current city, profile picture, user ID, friends list, etc.) and any additional information or activities that you allow the third party social network to share. We receive our social network profile information (or portions thereof) each time you download or interact with a Sosúa Ocean Village web app on a social network such as Facebook, each time you use a social network feature that is integrated into a Sosúa Ocean Village website (such as Facebook Connect) or each time you interact with Us through a social network. To learn more about how Sosúa Ocean Village obtains your social network information from third parties, or to opt out of sharing such social network information, please visit the relevant social network website.
Payment and financial information. Any information that we require in order to fulfill a reservation or purchase, or that you use to place any type of order, such as debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if made available). In all cases, we handle payment and financial information in accordance with applicable laws, regulations and security standards.
Calls to Customer Service Center. Communications with a customer service center may be recorded and listed, in accordance with applicable laws, to meet local operational needs (e.g., for training or quality purposes) as well as, in certain cases, to provide traceability of the consent given for the fulfillment of certain purposes. Payment card data is not recorded. Where required by law, you will be informed of such recording at the beginning of your call and will have the opportunity to object.
III. Cookies/Similar Technologies, Log Files and Web Beacons.
Cookies/Similar Technologies. A “Web Cookie” or “Cookie” is a string of information that assigns a unique identification that a Web Site stores on a user's computer, and that the user's browser provides to the Web Site each time the user submits a query to the Web Site. We use Cookies on the Website to keep track of services you have used, record registration information regarding your user name and password, record your user preferences, keep you logged in to the Website and facilitate checkout procedures. The Company may use Cookies to track the pages users visit during each session on the Website, both to help the Company improve user experiences and to help the Company understand how the Website is used. As with other non-personally identifiable information collected from users of the Web Site, the Company analyzes and discloses in aggregate form information collected using Cookies in order to help the Company understand how users use the Web Site.
Company, its partners and others to better understand how the Website is being used. USERS OF THE COMPANY WHO DO NOT WISH TO HAVE COOKIES PLACED ON THEIR COMPUTERS SHOULD SET THEIR BROWSER TO REJECT COOKIES BEFORE ACCESSING THE WEBSITE, UNDERSTANDING THAT CERTAIN FUNCTIONS OF THE WEBSITE MAY NOT FUNCTION PROPERLY WITHOUT THE AID OF COOKIES. USERS OF THE WEBSITE WHO REFUSE COOKIES ASSUME FULL RESPONSIBILITY FOR ANY RESULTING LOSS OF FUNCTIONALITY.
Log Files. We store information in the form of log files (“logs”) that record web activity and gather statistics about your Internet browsing habits. These entries are generated automatically and help us identify and fix problems or errors, improve compliance and maintain the security of our web pages.
IV. Uses of Personal Data
The following paragraphs describe the different purposes for which we collect and process your Personal Data, as well as the different types of Personal Data collected for each purpose. Please note that not all of the purposes listed below will have the same relevance for each data subject.
Customer Service. We use your Personal Data for purposes related to the provision of services to customers, including responding to their requests. These types of services usually involve the processing of some contact data, as well as information related to the content of the request (i.e. status of the request, technical aspects, product complaints or questions, general questions, etc.).
Contests, marketing and other promotions. With your consent (where required), we process your Personal Data to provide you with information about goods and services (i.e. marketing communications, campaigns or promotions). This may be done via email, advertisements, SMS, telephone calls or by post, in accordance with applicable law from time to time. Some of our campaigns and promotions are managed by third party websites and/or social networks. The use of your Personal Data is voluntary, which implies that you can object to the processing of your Personal Data (or withdraw your consent) for these purposes.
Social networks: We use your Personal Data when you interact on third party social networks, (i.e. using features such as “Like”), to provide you with advertisements and target you on social networks. You can learn more about how these features work, the profile data we collect from you, and how to opt out of these features by accessing the privacy policies of the major social networks.
Personalization (online and offline). With your consent (where required), we will process your Personal Data to (i) analyze your preferences and habits, (ii) anticipate your needs based on our analysis of your profile, (iii) improve and personalize your experience on our websites and apps, (iv) ensure that the content of our websites and apps is optimized for you and your computing devices, (v) provide you with advertising and content targeted to your tastes and/or needs, and (vi) allow you to participate in interactive features, if you wish. The use of Personal Data is voluntary, which means that you can object to the processing of your Personal Data (or withdraw your consent) for this purpose.
Management of reservations and requests. We use your Personal Data to process and send your reservations and requests, inform you of their status, correct addresses and carry out identity checks and other fraud detection activities. This involves the processing of certain Personal Data and payment information.
Other general purposes (e.g., internal research, analytics, security). In accordance with applicable law, we use your Data for other general professional purposes, including conducting internal demographic or marketing studies, or measuring the effectiveness of advertising campaigns. We also use your Personal Data to ensure our security.
V. Disclosure of Personal Data
We share your Personal Data with the following types of third party companies:
Service providers. These are outside companies that We use to operate Our business (e.g., payment processing, fraud detection and identity verification, debt collection, website operation, promotions, website development, data analysis, consumer service center, etc.). Service providers and their selected personnel are only permitted to access and use your Personal Data on Our behalf for the specific tasks they have been asked to perform, in accordance with Our instructions, and are requested to keep the Personal Data confidential and secure.
Credit reporting agencies/collection agents. To the extent permitted by applicable laws, credit reporting agencies and collection agents are third party companies that we use to help us verify your creditworthiness (in particular for invoiced orders) or to collect outstanding invoices.
Third-party companies that use Personal Data for their own marketing purposes. Except in situations where you have given your consent, we do not license or sell your Personal Data to third party companies for their own marketing purposes. We will provide you with the identity of these companies at the time we obtain your consent.
Third party recipients who use your Personal Data for legal reasons or due to a merger/acquisition. We will disclose your Personal Data to third parties for legal reasons or in the context of an acquisition or merger.
VI. Retention of your Personal Data
Subject to applicable laws, we will use your Personal Data to the extent necessary to fulfill the purposes for which it was collected (as described in Section 4 above) or to comply with applicable legal requirements.
Personal Data used to provide you with a personalized experience (see Section 4 above for details) will be retained for the duration permitted by applicable laws.
VII. Disclosure, Storage and/or Transfer of Personal Data
We use a variety of reasonable measures (described below) to keep your Personal Data confidential and secure. Please note, however, that these protections do not apply to information you choose to share in public areas such as social networks.
Persons who may access your Personal Data. Your Personal Data will be processed by authorized personnel on a need-to-know basis, depending on the specific purposes for which your Personal Data was collected (e.g., our customer service personnel will have access to your customer record).
Actions taken in operational environments. We store your Personal Data in operating environments that use reasonable security measures to prevent unauthorized access. We follow reasonable standards to protect Personal Data. The transmission of information over the Internet is, unfortunately, not entirely secure, and while we do our best to protect Personal Information, we cannot guarantee the security of data during transmission via our Websites/apps.
Actions we expect you to take. It is important that you also do your part in keeping your Personal Data secure. When signing up for an online account, be sure to choose an account password that is difficult for others to find out and never disclose your password to anyone. You are responsible for keeping this password confidential and for any use of your account. If you use a public or shared computer, do not choose to have your login ID/email address or password remembered and be sure to log off each time you leave the computer. You should also make use of the privacy settings or controls that We provide on our Website/app.
VIII. Your Rights Regarding Your Personal Data
Access to your Personal Data. When provided by law, you, your successors, representatives and/or proxies have the right to access, review and request a physical or electronic copy of information stored about you. You may also have the right to request information about the source of your Personal Data.
Modification and deletion of your Personal Data. When provided by law, you, your successors, representatives and/or attorneys-in-fact may request the correction or modification of your Personal Data. You also have the right to request the deletion of your Personal Data so that they cease to be processed, by your own decision, if they are no longer necessary for the purposes for which they were collected, or if they are otherwise processed, especially if you have withdrawn your consent to the processing, or you object to a particular processing.
Please note that in certain circumstances we will not be able to delete your Personal Data without also deleting your user account. We may be required to retain some of your Personal Data after you have requested deletion, in order to comply with our legal or contractual obligations or to meet our business needs, all in accordance with applicable law.
Limitation of processing of your Personal Data. In certain circumstances and where provided by law, you, your successors, representatives and/or attorneys may request that Sosúa Ocean Village limit the processing of your data for certain purposes, in which case we will only retain it for the exercise or defense of claims.
Portability of your Personal Data. In the event that the processing of Personal Data is based on the consent given by you or when the processing is necessary for the execution of a contract, you may request to receive in a structured, commonly used, machine-readable and interoperable format all data processed through automated means.
Opposition to the processing of your Personal Data. In cases where your Personal Data is processed for the purpose of satisfying legitimate interests of Sosúa Ocean Village, in certain circumstances, you will have the right to object totally or partially (that is, for certain purposes) to the processing of any personal data relating to your particular situation, and this at any time and at no cost.
Revocation of consent. In the event that the legitimate basis for the use of your data is the consent given by you expressly or unequivocally, you have the right to withdraw your consent for us to process your data for one, several or all of the related groups of purposes.
These rights can be exercised by email or post or by contacting our customer service department, for which we may ask you to attach a copy of your identification or equivalent details (including enhanced mechanisms to prove your identity where we request it and it is not prohibited by law). If the request is made by someone other than you, without providing evidence that the request has been lawfully made on your behalf, the request may be rejected.
Please note that any identification information you provide to us will only be processed in accordance with and to the extent permitted by applicable law.
IX. Your choices regarding how we use and disclose your personal data
We strive to provide you with choices regarding the Personal Data you provide to us. The following mechanisms give you the following control over your Personal Data:
Cookies/similar technologies. You can set your browser to reject all or some browser cookies, or to alert you when cookies are being used.
Advertising, marketing and promotions. If you decide that you do not want Sosúa Ocean Village to promote products or services to you that it believes may be of interest to you based on your Personal Data, you may opt out of receiving commercial communications at any time by following the instructions provided in each such communication. To opt out of receiving commercial communications sent by any means, including third-party social networks, you may opt out at any time by logging into the Websites/apps and adjusting your user preferences in your account profile by unchecking the relevant boxes or by calling our customer service center. Please note that even if you opt out of receiving marketing communications, you may still receive administrative communications, such as a reservation or order confirmation or other transactional communications, notifications about your account activities, and other important non-marketing related notices.
Interest-Based Advertising. We may partner with advertising networks and other advertising service providers (“Advertising Providers”) that serve ads on our behalf and other third-party companies across the Internet. Some of these ads may be tailored to your interests based on information collected on Sosúa Ocean Village pages or on third-party websites over time.
Targeted Advertising: Your personal information may also be used to match it with that of third parties (for example, Internet search engines or social media providers, such as Google, Facebook or Instagram) for advertising purposes, for which we may need to disclose your data to those third parties. Using various tools, we can match the data you provide to us with any personal information about you that is part of your profile on a search engine or on your social network, provided that you allow that social network to share it with us. We may also target our advertising to social network users who have a profile similar to yours or to regular consumers of our products.
We may also display marketing communications to you on other websites, including search engines you use or social networks of which you are a member, by matching your information and activities on our websites, accounts or walls with those third parties. For example, we may receive information from your social network profile whenever you download or interact with a Sosúa Ocean Village web application on a social network, such as Instagram or Facebook, or whenever you use a social network feature that is integrated within a Sosúa Ocean Village website. This includes basic account information (name, email address, gender, date of birth, current city, profile picture, user ID, friends list, etc.) and any additional information or activities that you permit the social network or search engine to share with Sosúa Ocean Village or the application developers. In some cases, we may use geolocation tools to send you offers and promotions based on your precise geographic location.
You may stop receiving marketing communications via email or text message through your phone, tablet or mobile device by continuing to contact us through any of the communication channels.
X. Changes to our policy
If we change the way we process Personal Data, we will update this Policy. We reserve the right to make changes at any time to our practices and this Policy, so we encourage you to check it frequently for updates or changes.
